Definitions:
- “Listing”: A boat rental offer published on the Site by an Owner.
- “Boat”: Any nautical vessel offered for Rental on the Site (sailboats, motorboats, etc.).
- “Renter”: Any natural person or legal entity renting a Boat.
- “Rental”: The rental of a Boat by an Owner to a Renter.
- “Rental Price”: The price displayed in the Listing, excluding any additional options. Unless otherwise specified, it does not include mooring or fuel.
- “Owner Price”: The price set by the Owner for the Rental, including the Rent Boat Cyprus commission.
- “Owner”: Any natural person or legal entity proving full ownership of a Boat. This also refers to Owners’ representatives with proven authorization.
- “Professional Owner”: An Owner using the Service on a professional basis, declared according to Cyprus regulations.
- “Private Owner”: An Owner not using the Service on a professional basis.
- “Service”: The service of connecting Owners and Renters for Boat Rentals, and managing bookings and payments.
- “Site”: The Rent Boat Cyprus website (www.rentboat.cy) and any associated mobile applications.
- “User”: Any user of the Site and the Service, whether Owner or Renter.
- “Start Date”: The first day of the Rental period.
- “Inventory Before Use”: A document describing the Boat’s condition at the Start Date, completed and signed by both Renter and Owner (or representative).
- “Inventory After Use”: A document describing the Boat’s condition at the end of the Rental, completed and signed by both Renter and Owner (or representative).
- “Additional Options”: Any extras offered by the Owner in addition to the Rental Price (e.g., cleaning).
- “Rent Boat Cyprus Commission”: The fee payable by the Owner to Rent Boat Cyprus for the Service.
- “Content”: Any text, images, videos, or other material Users post on the Site.
1. Introduction
These Terms and conditions apply to this website and to the transactions related to our products and services. You may be bound by additional contracts related to your relationship with us or any products or services that you receive from us. If any provisions of the additional contracts conflict with any provisions of these Terms, the provisions of these additional contracts will control and prevail.
2. Binding
By registering with, accessing, or otherwise using this website, you hereby agree to be bound by these Terms and conditions set forth below. The mere use of this website implies the knowledge and acceptance of these Terms and conditions. In some particular cases, we can also ask you to explicitly agree.
3. Electronic communication
By using this website or communicating with us by electronic means, you agree and acknowledge that we may communicate with you electronically on our website or by sending an email to you, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.
4. Intellectual property
We or our licensors own and control all of the copyright and other intellectual property rights in the website and the data, information, and other resources displayed by or accessible within the website.
4.1 All the rights are reserved
Unless specific content dictates otherwise, you are not granted a license or any other right under Copyright, Trademark, Patent, or other Intellectual Property Rights. This means that you will not use, copy, reproduce, perform, display, distribute, embed into any electronic medium, alter, reverse engineer, decompile, transfer, download, transmit, monetize, sell, market, or commercialize any resources on this website in any form, without our prior written permission, except and only insofar as otherwise stipulated in regulations of mandatory law (such as the right to quote).
5.Use of the Service
5.1 User Accounts
Account Creation: To use the Service, Users must create an account by providing accurate and complete information as requested during the registration process. This may include, but is not limited to, name, contact details, and, for Owners, details about their Boat(s).
Account Confidentiality: Users are solely responsible for maintaining the confidentiality of their account credentials, including their username and password. Do not share these credentials with anyone!
Unauthorized Access: Users must immediately notify Rent Boat Cyprus of any unauthorized access to their account or any suspected breach of security. Notification should be made via the contact information provided on the Site.
Information Updates: Users are responsible for keeping their account information accurate and up-to-date. Changes to contact details, Boat information (for Owners), or any other relevant details must be made promptly through the account settings.
Account Responsibility: All activities that occur under a User’s account are the responsibility of the account holder. Rent Boat Cyprus is not liable for any actions taken by unauthorized users who have gained access to an account through the User’s negligence.
5.2 Listings (for Owners)
Listing Accuracy: Owners are solely responsible for the accuracy and completeness of their Listings. All information provided must be truthful and not misleading.
Required Information: Each Listing must include, but is not limited to:
- Boat Details: Make, model, year, length, capacity, engine details, equipment (including safety equipment), and any other relevant specifications.
- Boat Location: The usual mooring location of the Boat.
- Mooring Information: Specify whether mooring in the home port is included in the Rental Price. If not, clearly state any associated costs.
- Required Qualifications: Specify any required licenses, certifications, or experience needed to operate the Boat. If a skipper is required, state this clearly.
- Availability Dates: Clearly indicate the dates and times the Boat is available for rent.
- Pricing:
- Daily Owner Price: The total price the Owner will receive for a one-day rental, inclusive of the Rent Boat Cyprus Commission.
- Hourly Owner Price (if applicable): The total price the Owner will receive for a one-hour rental, inclusive of the Rent Boat Cyprus Commission. Clearly state any minimum rental period.
- Late Return Fees: Specify the hourly or daily rate that will be charged for late returns. Be clear about how “late” is defined.
- Security Deposit (if applicable): The amount of the security deposit required, if any.
- Additional Costs: Clearly list any additional costs, such as cleaning fees, fuel costs (if not included), or other optional extras. Provide a detailed breakdown of these costs.
- Cancellation Policy: Clearly state the Owner’s cancellation policy, including any fees that may apply. This policy must be compliant with applicable laws and regulations.
Owner Price and Rental Price: The Owner Price, as stated above, includes the Rent Boat Cyprus Commission. Rent Boat Cyprus will display the Rental Price to Renters, which is the Owner Price plus any additional costs.
5.3 Owner Obligations Regarding Boat Condition
Maintenance and Equipment: Owners are responsible for ensuring that their Boats are in good working order, properly maintained, and equipped with all necessary safety equipment as required by law and good seamanship practices. This includes, but is not limited to:
- Regular inspections and maintenance.
- Proper functioning of all mechanical and electrical systems.
- Availability of life jackets, first-aid kit, navigation equipment, and other safety items.
Seaworthiness: Owners must ensure that their Boats are seaworthy and suitable for the intended use and sailing area.
5.4 Renter Booking
Booking Offer: Renters select a Boat and desired rental dates through the Site. This constitutes a Booking Offer.
Owner Response: Owners have 72 hours to accept or decline a Booking Offer. If no response is received within this timeframe, the Booking Offer may be considered automatically declined.
5.5 Bookings
Confirmation and Contact Information: Upon confirmation of a booking by the Owner, Rent Boat Cyprus will share the necessary contact information between the Renter and Owner to facilitate communication regarding the Rental. This information may only be used for communication related to the specific booked Rental.
Rental Agreement and Inventories:
- Inventory Before Use: On the Start Date, the Owner and Renter (or their authorized representatives) must conduct a thorough inspection of the Boat and complete and sign an “Inventory Before Use” form. This form should document the condition of the Boat, including any existing damage, and be supported by photographs.
- Inventory After Use: At the end of the Rental period, the Owner and Renter (or their representatives) must again inspect the Boat and complete and sign an “Inventory After Use” form, documenting its condition upon return. Any new damage or discrepancies should be clearly noted.
- Rental Agreement: The Owner and Renter must sign a formal Rental Agreement that clearly outlines the terms and conditions of the Rental, including the rental period, price, payment terms, security deposit terms, responsibilities of each party, cancellation policy, and procedures in case of damage or breakdown.
5.6 Security Deposit
- Deposit Requirement: Owners may require a security deposit from Renters. The amount of the security deposit must be clearly stated in the Listing.
- Renter Funds: Renters are responsible for ensuring they have sufficient funds available to cover the security deposit.
- Deposit Management: Rent Boat Cyprus may facilitate the management of the security deposit .
- Damage Claims: Within 24 hours of the end of the Rental period, the Owner may submit a claim for damages to Rent Boat Cyprus, providing detailed supporting documentation, including the signed Inventory Before Use and Inventory After Use forms, photographs of the damage, repair estimates, and any other relevant evidence.
- Dispute Resolution: Any disputes between the Owner and Renter regarding the security deposit or damages are solely between the Owner and Renter. Rent Boat Cyprus will not act as an arbitrator in these disputes.
5.7 User Reviews
- Reviewing Process: Users who have completed a Rental through the Service may leave reviews and ratings for each other.
- Review Content: Reviews must be respectful, factual, and relevant to the Rental experience. Reviews containing offensive language, personal attacks, or false information are prohibited.
- Review Moderation: Rent Boat Cyprus reserves the right to remove any reviews that violate these Terms and Conditions
6. Obligations of the Parties
6.1 User Obligations (Both Owners and Renters)
All Users of the Site and Service agree to the following general obligations:
- Compliance with Laws and Terms: Users must comply with these Terms and Conditions, all applicable laws, regulations, and maritime rules of Cyprus, including but not limited to those related to boat operation, safety, and environmental protection.
- Accuracy of Information: Users must provide only truthful, accurate, and up-to-date information in their profiles, Listings (for Owners), communications, and any other interactions with the Site or Service. Misrepresenting oneself or one’s Boat is strictly prohibited.
- Good Faith: Users must act in good faith in all interactions with other Users and Rent Boat Cyprus. This includes honest communication, fair dealings, and respecting the rights of others.
- Single Account: Users may create and maintain only one User account. Creating multiple accounts or accounts for others is prohibited without explicit written consent from Rent Boat Cyprus.
- Account Security: Users are solely responsible for maintaining the confidentiality of their account credentials, including their username and password. Do not share these credentials with anyone. Users must immediately notify Rent Boat Cyprus of any unauthorized access to their account or any suspected breach of security.
- Information Updates: Users are responsible for keeping their account information accurate and up-to-date. Changes to contact details, Boat information (for Owners), qualifications, or any other relevant details must be made promptly through the account settings.
- No Account Transfer: Users may not transfer or assign their User account to any third party.
- Respectful Communication: All communication through the Site or related to the Service must be respectful and professional. Harassment, discrimination, or any form of abusive behavior is strictly prohibited.
6.1.1 Specific Obligations of Owners
In addition to the general User obligations, Owners specifically agree to the following:
- Proof of Ownership: Owners must be able to provide verifiable proof of ownership for each Boat they list on the Site.
- Boat Maintenance and Equipment: Owners are solely responsible for ensuring that their Boats are in good working order, properly maintained, and equipped with all necessary safety equipment as required by law and good seamanship practices. This includes, but is not limited to:
- Regular inspections and maintenance by qualified personnel.
- Proper functioning of all mechanical, electrical, and navigation systems.
- Availability of appropriate life jackets for all passengers, a first-aid kit, flares, navigation equipment, and other safety items as required by regulations.
- Seaworthiness: Owners must ensure that their Boats are seaworthy and suitable for the intended use and sailing area. They are responsible for determining whether weather conditions are appropriate for sailing.
- Qualifications and Certifications: Owners must possess and maintain any required licenses, certifications, or qualifications necessary to operate their Boats legally and safely.
- Renter Verification: Owners are responsible for verifying the identity and qualifications of Renters before allowing them to operate their Boats. This includes checking licenses, certifications, and experience.
- Provision of Invoices: Owners must provide Renters with invoices for the Rental Price upon request.
- Compliance with Regulations: Owners must comply with all applicable laws and regulations related to boat rentals, including tax obligations, safety regulations, and environmental regulations.
6.1.2 Specific Obligations of Renters
In addition to the general User obligations, Renters specifically agree to the following:
- Funds for Security Deposit: Renters must have sufficient funds available to cover the security deposit required by the Owner.
- Boat Condition Verification: Renters are responsible for carefully inspecting the Boat before taking possession and noting any existing damage or discrepancies on the Inventory Before Use form.
- Notification of Discrepancies: Renters must immediately notify Rent Boat Cyprus and the Owner of any discrepancies between the Boat’s actual condition and the information provided in the Listing.
- Payment of Fines: Renters are responsible for paying any fines they incur during the Rental period, including but not limited to traffic violations, parking fines, or fines for violating maritime regulations.
- Required Qualifications: Renters must possess and maintain any required licenses, certifications, or qualifications necessary to operate the Boat legally and safely.
- Punctuality: Renters must arrive at the agreed-upon time and location for the start of the Rental period.
- Contract Signing: Renters must sign the Rental Agreement and Inventory Before Use form before taking possession of the Boat.
- Responsible Boat Use: Renters must operate the Boat responsibly and safely, adhering to all applicable maritime rules and regulations. This includes, but is not limited to:
- Not operating the Boat under the influence of alcohol or drugs.
- Respecting speed limits and no-wake zones.
- Not exceeding the Boat’s passenger capacity.
- Protecting the Boat and its equipment from damage.
- Return of Boat: Renters must return the Boat to the agreed-upon location at the agreed-upon time, in the same condition it was received, reasonable wear and tear excepted. This includes ensuring the Boat is clean and properly secured.
6.2 Obligations of Rent Boat Cyprus
Rent Boat Cyprus agrees to the following:
Support: Rent Boat Cyprus will provide reasonable support to Users related to the use of the Site and Service.
Site Availability: Rent Boat Cyprus will strive to maintain the availability of the Site and Service, but does not guarantee uninterrupted access.
Inquiry Response: Rent Boat Cyprus will make reasonable efforts to respond to User inquiries in a timely manner.
Payment Processing: Rent Boat Cyprus will process payments between Renters and Owners as described in these Terms and Conditions.
7. Cancellation of Bookings
All cancellations must be initiated through the Site by the User who wishes to cancel. Verbal cancellations will not be accepted. The canceling party must follow the cancellation procedure outlined on the Site. A cancellation is only considered effective after Rent Boat Cyprus has sent a confirmation email to all involved parties.
7.1 Force Majeure
- Definition: “Force Majeure” refers to events beyond the reasonable control of either party, including but not limited to: severe weather conditions (as officially declared by relevant meteorological agencies), natural disasters (e.g., earthquakes, floods, hurricanes), war, acts of terrorism, civil unrest, government actions, strikes, and other similar events.
- Notification: In the event of a Force Majeure event, the affected User must notify Rent Boat Cyprus as soon as reasonably practicable, providing documentation or evidence supporting the claim of Force Majeure.
- Options: If a booking is affected by Force Majeure, the parties may agree to:
- Postponement: Reschedule the booking to a mutually agreed-upon date in the future.
- Cancellation: Cancel the booking.
- Refunds (if applicable): The handling of refunds in Force Majeure situations will depend on the specific circumstances and will be determined on a case-by-case basis. Rent Boat Cyprus will work with the parties to reach a fair resolution. Clearly define your specific refund policy for Force Majeure events here. For example, will you refund the full amount, a portion of the amount, or offer a credit for future bookings? Be very specific.
7.2 Owner Cancellations
Cancellation Policy: Renters may cancel a booking subject to the cancellation policy specified by the Owner in the Listing. Renters are responsible for carefully reviewing the cancellation policy before making a booking. It is the Renter’s responsibility to understand the Owner’s cancellation terms.
Cancellation Fees: Cancellation fees, if any, will be determined according to the Owner’s stated cancellation policy. These fees are set by the Owner, not Rent Boat Cyprus.
Refunds: Refunds for Renter cancellations will be processed according to the Owner’s cancellation policy and these Terms and Conditions, with the following important stipulations regarding Rent Boat Cyprus’s fees:
- Rent Boat Cyprus Fees are Non-Refundable: Regardless of the Owner’s cancellation policy, the Rent Boat Cyprus commission and any other fees charged by Rent Boat Cyprus (e.g., booking fees, processing fees) are non-refundable. These fees cover the cost of the services provided by Rent Boat Cyprus, such as facilitating the booking and maintaining the platform, and are earned upon confirmation of the booking.
- Refund Calculation: The refund amount will be calculated based on the Owner’s cancellation policy minus the non-refundable Rent Boat Cyprus fees.
- Processing Time: Refunds will be processed by Rent Boat Cyprus within a reasonable timeframe, typically within 7 – 40 business days. However, the actual time it takes for the refund to appear in the Renter’s account may depend on the Renter’s bank or payment provider.
Examples: To illustrate how refunds are handled, here are some examples:
- Example 1: Flexible Cancellation Policy: The Owner’s cancellation policy states that the Renter can receive a full refund if they cancel at least 7 days before the Start Date. The Rental Price is €500, and the Rent Boat Cyprus commission is €50. If the Renter cancels 8 days before the Start Date, they will receive a refund of €450 (€500 – €50).
- Example 2: Moderate Cancellation Policy: The Owner’s cancellation policy states that the Renter will receive a 50% refund if they cancel between 7 and 3 days before the Start Date. The Rental Price is €500, and the Rent Boat Cyprus commission is €50. If the Renter cancels 5 days before the Start Date, they will receive a refund of €200 (€500 x 50% – €50).
- Example 3: Strict Cancellation Policy: The Owner’s cancellation policy states that no refund will be given if the Renter cancels less than 3 days before the Start Date. The Rental Price is €500, and the Rent Boat Cyprus commission is €50. If the Renter cancels 2 days before the start date, they will receive no refund (€0).
- Example 4: Cancellation by Owner: If the Owner cancels the booking (without a valid Force Majeure reason), the Renter will receive a full refund of the Rental Price including the Rent Boat Cyprus commission. In this specific case, Rent Boat Cyprus will absorb the commission fee as a penalty to the Owner.
Clarification: It is the Renter’s responsibility to carefully review the Owner’s cancellation policy before booking. By making a booking, the Renter acknowledges and agrees to the Owner’s cancellation policy and the non-refundable nature of the Rent Boat Cyprus fees.
7.4 Rent Boat Cyprus Cancellations
- Reasons for Cancellation: Rent Boat Cyprus reserves the right to cancel a booking in certain situations, including but not limited to:
- Violation of these Terms and Conditions by either party.
- Fraudulent activity or suspected fraudulent activity.
- Non-payment by the Renter.
- Boat unavailability due to unforeseen circumstances (e.g., damage, repairs).
- Technical issues or maintenance affecting the Site or Service.
- Alternative Arrangements: In cases where Rent Boat Cyprus cancels a booking, reasonable efforts will be made to offer the Renter an equivalent alternative Boat.
- Refunds: If no suitable alternative is available, the Renter will receive a full refund of all payments made.
8. Payment Terms
Payment in Advance: Renters are required to pay the full Rental Price in advance through the Site’s secure payment system, which is powered by Stripe. Payment can be made using credit cards (Visa, Mastercard, American Express, and other cards accepted by Stripe), debit cards, and other payment methods supported by Stripe. Rent Boat Cyprus does not accept offline payments.
Payment Processing: All payments are processed securely by Stripe. By using the Site and making a booking, Renters authorize Rent Boat Cyprus, via Stripe, to charge their chosen payment method for the Rental Price. Renters agree to Stripe’s terms of service and privacy policy, which are available at Stripe terms and conditions.
Rental Price Breakdown: The Rental Price displayed to the Renter includes:
- The Owner Price (the amount the Owner receives).
- The Rent Boat Cyprus Commission (the fees and commissions for using the Service).
- Any applicable additional costs specified in the Listing (e.g., cleaning fees, optional extras).
Owner Payout: Rent Boat Cyprus will transfer the Owner Price (the Rental Price minus the Rent Boat Cyprus Commission and any other applicable fees) to the Owner’s designated bank account in 15 business days after the Start Date of the Rental, subject to the following conditions:
- No Claims Filed: The Owner payout is contingent upon no claims being filed by the Renter regarding the Rental. If a claim is filed, the payout may be delayed or withheld pending resolution of the claim (see section 5.6 regarding Security Deposits and Claims).
- Verification of Rental Completion: Rent Boat Cyprus may, at its discretion, require verification that the Rental has commenced before releasing funds to the Owner. This may involve confirmation from either the Renter or the Owner.
- Payment Method: The Owner must provide Rent Boat Cyprus with accurate and up-to-date bank account details for receiving payments. Rent Boat Cyprus is not responsible for any delays or errors in payment due to incorrect bank information provided by the Owner.
Currency: All transactions on the Site are conducted in Euro (€).
Payment Disputes: If a Renter disputes a charge, they must contact Rent Boat Cyprus within 14 days of the charge date. Rent Boat Cyprus will investigate the dispute and work with Stripe and the Renter and Owner to reach a resolution. However, Rent Boat Cyprus is not obligated to act as a mediator in payment disputes, and ultimately, any legal recourse must be pursued directly between the Renter and the Owner, and/or Stripe, as appropriate.
Taxes: Renters and Owners are responsible for handling any applicable taxes related to the Rental transaction. Rent Boat Cyprus is not responsible for collecting or remitting taxes.
No Direct Payments: Renters and Owners are strictly prohibited from making direct payments to each other outside of the Rent Boat Cyprus platform. All payments must be processed through the Site’s payment system via Stripe. Violating this provision may result in account suspension or termination.
Payment Confirmation: Upon successful payment, Renters will receive a confirmation email with details of the transaction from Stripe. Owners will receive notification when funds are transferred to their account.
9. Availability of Service and Site
Service Availability Efforts: Rent Boat Cyprus will make reasonable efforts to ensure that the Site and Service are available 24 hours a day, 7 days a week. This includes maintaining the necessary hardware, software, and network infrastructure.
No Guarantee of Uninterrupted Access: While Rent Boat Cyprus strives for continuous availability, it does not guarantee uninterrupted access to the Site and Service. Users acknowledge and accept that access may be subject to temporary interruptions, delays, or limitations.
Reasons for Interruptions: Interruptions may occur due to, but are not limited to:
- Scheduled maintenance or upgrades.
- Unscheduled maintenance or emergency repairs.
- Technical issues, such as hardware or software failures, network outages, or bugs.
- Third-party service provider issues (e.g., internet service providers, hosting providers).
- Force Majeure events (as defined in section 7.1).
- Security incidents or attacks.
Notification of Maintenance: Rent Boat Cyprus will make reasonable efforts to notify Users of scheduled maintenance or upgrades that may affect Site availability. However, no prior notice is guaranteed, especially in cases of emergency maintenance.
No Liability for Interruptions: Rent Boat Cyprus will not be liable for any losses, damages, or inconvenience incurred by Users due to any interruptions, delays, or limitations in access to the Site or Service, regardless of the cause.
User Responsibility: Users are responsible for having alternative means of communication in case of Site unavailability, particularly if they have an upcoming rental. Rent Boat Cyprus recommends that Users keep records of their booking details and contact information.
Service Modifications: Rent Boat Cyprus reserves the right to modify, suspend, or discontinue any aspect of the Site or Service, including features, functionality, or content, at any time without notice. Rent Boat Cyprus will not be liable to Users for any such modifications, suspensions, or discontinuances.
10. Liability
No Party to Rental Contracts: Rent Boat Cyprus acts as a platform to connect Owners and Renters. It is not a party to the Rental contracts entered into between these Users. The Rental contract is a separate agreement solely between the Owner and the Renter.
Exclusion of Liability for User Disputes: Rent Boat Cyprus will not be held liable for any disputes, disagreements, or claims arising between Users (Owners and Renters) related to the Rental contract, the Boat, the rental period, payment, security deposits, damages, or any other aspect of the Rental transaction. This includes, but is not limited to:
- Disputes regarding the condition of the Boat.
- Disagreements about payment or refunds.
- Claims for damages to the Boat or personal property.
- Disputes related to the fulfillment of the Rental contract.
Limited Liability: To the maximum extent permitted by applicable law, Rent Boat Cyprus’s liability to any User, regardless of the form of action (whether in contract, tort, or otherwise), will be limited to the amount of the Rent Boat Cyprus commission received by Rent Boat Cyprus for the specific Rental that is the subject of the claim. This limitation of liability applies even if Rent Boat Cyprus has been advised of the possibility of such damages.
Exclusion of Consequential Damages: Rent Boat Cyprus will not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, even if Rent Boat Cyprus has been advised of the possibility of such damages.
Disclaimer of Warranties: The Site and Service are provided “as is” and “as available” without any warranties of any kind, either express or implied. Rent Boat Cyprus does not warrant that the Site or Service will be error-free, uninterrupted, or that any information provided through the Site or Service will be accurate or reliable.
Indemnification: Users agree to indemnify and hold Rent Boat Cyprus harmless from any claims, damages, liabilities, and expenses (including legal fees) arising out of their use of the Site or Service, their breach of these Terms and Conditions, or their Rental transactions with other Users.
11. Force Majeure
Definition: “Force Majeure” means any event beyond the reasonable control of a party that prevents or delays the performance of its obligations under these Terms and Conditions. Such events may include, but are not limited to:
- Natural Disasters: Floods, earthquakes, hurricanes, tornadoes, wildfires, volcanic eruptions, or other acts of nature.
- Severe Weather: Exceptionally severe weather conditions, such as blizzards, ice storms, or dangerous sea conditions (as officially declared by relevant meteorological agencies).
- War and Terrorism: Acts of war, terrorism, sabotage, or civil unrest.
- Government Actions: Changes in laws or regulations, embargoes, national emergencies, or acts of government authorities.
- Labor Disputes: Strikes, lockouts, or other labor disputes.
- Utility Failures: Power outages, internet disruptions, or failures of essential utilities.
- Disease and Pandemic: Widespread illness, quarantine restrictions, or public health emergencies.
Notice: A party claiming Force Majeure must promptly notify the other party in writing (or via email) of the event and its expected duration. The notifying party must use reasonable efforts to provide evidence of the Force Majeure event.
Effect on Obligations: During the period of Force Majeure, the affected party’s obligations under these Terms and Conditions that are directly impacted by the Force Majeure event will be suspended. The affected party will not be liable for any failure or delay in performing these obligations to the extent that such failure or delay is caused by the Force Majeure event.
Reasonable Efforts: The affected party must use reasonable efforts to mitigate the effects of the Force Majeure event and resume performance of its obligations as soon as reasonably practicable.
Termination:
- Duration Triggering Termination: If a Force Majeure event continues for an extended period, specifically more than 7 days, either the Owner or the Renter may terminate the affected Rental contract.
- Termination Notice: The party choosing to terminate must provide written notice (or email) to the other party and to Rent Boat Cyprus. The notice should clearly state the intent to terminate due to the ongoing Force Majeure event.
- Consequences of Termination:
- Renter-Initiated Termination:
- If the Renter terminates the contract due to Force Majeure:
- Rental Price Refund: The Renter will receive a refund of the Rental Price excluding the Rent Boat Cyprus commission and fees. These remain non-refundable.
- Deductions: The refund may be subject to deductions for any expenses already incurred by the Owner that are directly attributable to the Rental (e.g., non-refundable mooring fees, fuel costs if already purchased).
- Owner-Initiated Termination:
- If the Owner terminates the contract due to Force Majeure:
- Full Refund: The Renter will receive a full refund of the Rental Price, including the Rent Boat Cyprus commission and fees.
- No Deductions: No deductions will be made from the refund for Owner expenses.
- Partial Rental Period: If the Force Majeure event occurs during the Rental period, causing the Boat to be unusable for the remainder of the period, the following applies:
- Prorated Refund: The Renter will receive a refund for the unused portion of the Rental period, calculated on a daily basis. The Rent Boat Cyprus commission and fees are non-refundable, except in the case of Owner-initiated termination due to Force Majeure, as explained above.
- Deductions (if applicable): As above, deductions may be made for Renter-initiated termination if there are verifiable Owner expenses directly related to the Rental.
Dispute Resolution: Any disputes arising from the termination of a Rental contract due to Force Majeure will be handled in accordance with the dispute resolution provisions in these Terms and Conditions.
Allocation of Risk: The allocation of risk for certain events (e.g., weather-related cancellations) may be specifically addressed in other sections of these Terms and Conditions or in the Rental Agreement. In such cases, the specific provisions will govern.
Examples: These examples are illustrative and should be tailored to your specific policies:
- If a Boat rental is canceled due to a hurricane, the Renter may be entitled to a refund as specified in the cancellation policy (after deducting Rent Boat Cyprus fees, as per section 7.3).
- If a Renter is unable to return the Boat on time due to a port closure caused by a storm, they may not be considered in breach of the Rental contract, but may still be responsible for any additional costs incurred (e.g., extended mooring fees).
12. Confidentiality
- Confidential Information: “Confidential Information” means any information disclosed by one party (the “Disclosing Party”) to the other party (the “Receiving Party”) in connection with these Terms and Conditions, the Site, or the Service, whether orally, in writing, electronically, or by any other means. Confidential Information includes, but is not limited to:
- User Information: Personal information of Users, including names, contact details, addresses, identification documents, financial information, and any other information that could be used to identify an individual.
- Business Information: Proprietary information of Rent Boat Cyprus, such as business plans, financial data, marketing strategies, customer lists, and technical information.
- Boat Information: Details about Boats listed on the Site, including specifications, ownership information, and availability.
- Rental Information: Details about Rental transactions, including booking information, pricing, and communications between Owners and Renters.
- Non-Use and Non-Disclosure: The Receiving Party agrees:
- Not to use the Disclosing Party’s Confidential Information for any purpose other than those directly related to these Terms and Conditions, the Site, or the Service.
- Not to disclose the Disclosing Party’s Confidential Information to any third party without the prior written consent of the Disclosing Party.
- Exceptions: The confidentiality obligations do not apply to information that:
- Was already known to the Receiving Party prior to disclosure.
- Is or becomes publicly known through no wrongful act of the Receiving Party.
- Is rightfully received by the Receiving Party from a third party without any obligation of confidentiality.
- Is required to be disclosed by law, regulation, or court order.
- Security Measures: Rent Boat Cyprus will implement and maintain reasonable security measures to protect User Confidential Information from unauthorized access, use, or disclosure. These measures may include, but are not limited to:

- Regular security assessments.
- Data Retention: Rent Boat Cyprus will retain User Confidential Information only for as long as necessary to fulfill the purposes for which it was collected or as required by law.

13. Suspension/Termination
Suspension or Termination by Rent Boat Cyprus: Rent Boat Cyprus reserves the right to suspend or terminate a User’s account, or restrict access to the Site or Service, at its sole discretion, for any reason, including but not limited to:
- Violation of Terms: Any violation of these Terms and Conditions, including but not limited to providing false information, engaging in fraudulent activity, or using the Site or Service for unauthorized purposes.
- Abuse of Service: Misuse of the Site or Service, including but not limited to spamming, harassment, or excessive use of resources.
- Non-Payment: Failure to pay for a Rental or any other fees owed to Rent Boat Cyprus.
- Security Risks: Any activity that poses a security risk to the Site, Service, or other Users.
- Legal Compliance: Failure to comply with applicable laws or regulations.
- Negative Reviews: Repeatedly receiving negative reviews from other Users, indicating a pattern of unreliable or unprofessional behavior.
- Account Inactivity: Extended periods of account inactivity of 12 months.
Suspension Procedures:
- Notice: Rent Boat Cyprus will make reasonable efforts to provide notice to the User before suspending or terminating their account, unless the suspension or termination is necessary to prevent immediate harm to the Site, Service, or other Users.
- Explanation: If possible, Rent Boat Cyprus will provide an explanation of the reason for the suspension or termination.
- Appeal: Users may have the opportunity to appeal a suspension or termination decision.
Effects of Suspension or Termination:
- Loss of Access: The suspended or terminated User will lose access to their account, the Site, and the Service.
- Forfeiture of Funds: In cases of termination for cause (e.g., violation of Terms), the User may forfeit any funds held in their account or any pending payments.
- No New Accounts: The suspended or terminated User may not create new accounts without the express permission of Rent Boat Cyprus.
Termination by User:
No Refunds: Termination of an account does not entitle the User to any refunds for fees already paid.
Termination Process: Users may terminate their accounts at any time by following the termination process outlined on the Site or by contacting Rent Boat Cyprus.
Pending Rentals: Users are responsible for completing any pending Rental transactions before terminating their account.

Links to Other Websites: The Site may contain hyperlinks or other references to websites operated by third parties (“Third-Party Websites”). These links are provided for your convenience and information only. Rent Boat Cyprus does not control, endorse, or monitor the content, availability, or practices of any Third-Party Websites.
No Responsibility for Third-Party Content: Rent Boat Cyprus is not responsible for the content of any Third-Party Websites, including but not limited to the accuracy, legality, or decency of such content. Any opinions, advice, statements, services, offers, or other information expressed or made available on Third-Party Websites are those of the respective authors or distributors and not of Rent Boat Cyprus.
Third-Party Terms and Conditions: Your access to and use of any Third-Party Website is subject to the terms and conditions and privacy policies of that website. It is your responsibility to review and understand those terms and conditions before using any Third-Party Website.
Risks of Third-Party Websites: You acknowledge and agree that Rent Boat Cyprus is not liable for any loss or damage that may result from your access to or use of any Third-Party Website or any dealings with any third party. This includes, but is not limited to, any loss or damage caused by:

- Transactions with a third party.

17. Refunds (Cooling-Off Period)
17.1 Right to a Refund
- 14-Day Period: You have the right to a full refund of a Rental contract within 14 days without giving any reason. This is a “cooling-off period” provided by Cyprus consumer protection law.
- Refund Period: The refund period expires 14 days after the day the Rental contract is concluded (i.e., the day you confirm the booking on the Site).
- Notification for Refund: To exercise your right to a refund, you must inform Rent Boat Cyprus of your decision by an unequivocal statement. This can be done by:
- Email: Send an email to customers@rentboat.cy clearly stating your intention to request a refund for the Rental contract.
- Contact Form: Submit a refund request through the contact form on the Site.
- Mail: Send a letter by post to Rent Boat Cyprus, P.O.Box 40557, 6305, Larnaca, Cyprus stating your intention to request a refund.
- Refund Request Form: You may use the model refund request form provided by Rent Boat Cyprus, but it is not obligatory. The model refund request form can be found here.
- Acknowledgement of Receipt: Rent Boat Cyprus will acknowledge receipt of your refund request without delay by sending you an email confirmation.
- Refund Deadline: To meet the refund deadline, it is sufficient for you to send your communication concerning your refund request before the 14-day period has expired.
17.2 Effects of Refund Request
- Refund: If you request a refund within the 14-day cooling-off period, Rent Boat Cyprus will reimburse you for all payments received from you, excluding the Rent Boat Cyprus commission and any other fees.
- Refund Method: The refund will be processed using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.
- Refund Timeframe: Rent Boat Cyprus will process the refund without undue delay and no later than 14 days from the day on which Rent Boat Cyprus is informed of your decision to request a refund.
- Exceptions: Please note that there may be some legal exceptions to the right to a refund, and some services may therefore not be subject to this cooling-off period. Rent Boat Cyprus will inform you if any such exceptions apply to your specific Rental.
18. User-Generated Content
Open Communication Tools: Rent Boat Cyprus may provide various open communication tools on the Site, such as:
- Blog comments
- Blog posts
- Forums
- Message boards
- Ratings and reviews
- Social media integrations (e.g., Facebook comments)
No Guarantee of Content Moderation: While Rent Boat Cyprus encourages users to engage in respectful and constructive dialogue, it may not be feasible for Rent Boat Cyprus to screen or monitor all content that users share or submit on or through the Site.
Content Review and Removal: Rent Boat Cyprus reserves the right, but not the obligation, to:

- Remove or reject any content, in its sole discretion, for any reason, including but not limited to content that:

No Unsolicited Submissions: Rent Boat Cyprus does not accept or consider unsolicited ideas, inventions, works of authorship, or other information that can be considered your own intellectual property (“Unsolicited Submissions”). This includes, but is not limited to, ideas for new products or services, marketing campaigns, designs, or software.
Prior Written Agreement: If you wish to submit any Unsolicited Submissions to Rent Boat Cyprus, you must first contact Rent Boat Cyprus and obtain a signed agreement regarding intellectual property rights or a non-disclosure agreement (“NDA”). The agreement or NDA should clearly define the ownership and use rights of the submitted information.
License Grant: If you disclose any Unsolicited Submissions to Rent Boat Cyprus without a prior written agreement or NDA, you automatically grant Rent Boat Cyprus a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate, and distribute your Unsolicited Submissions in any existing or future media for any purpose.
No Obligation: Rent Boat Cyprus has no obligation to:
- Review or consider any Unsolicited Submissions.
- Keep any Unsolicited Submissions confidential.
- Compensate you for any Unsolicited Submissions.
Purpose: This policy is intended to avoid potential misunderstandings or disputes regarding the ownership of intellectual property.
20. Modification and Discontinuation of Service
Right to Modify or Discontinue: Rent Boat Cyprus reserves the right, in its sole discretion, to modify, suspend, or discontinue, temporarily or permanently, the Site, the Service, or any part thereof, at any time, with or without notice. No Circumvention: You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the Site. This includes, but is not limited to, using unauthorized methods to access the Site, creating multiple accounts, or using proxy servers.

- No Implied Warranties: To the maximum extent permitted by applicable law, Rent Boat Cyprus expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section will limit or exclude any warranty implied by law that it would be unlawful to limit or exclude.
- “As Is” and “As Available”: The Site, the Service, and all content and information provided on or through them are provided “as is” and “as available” without warranty of any kind. Rent Boat Cyprus does not warrant that the Site, the Service, or any content will be accurate, complete, reliable, up-to-date, secure, or error-free.
- Boat Condition: Rent Boat Cyprus makes no warranties or representations regarding the condition, seaworthiness, or suitability for any particular purpose of any Boat listed on the Site. It is the responsibility of the Owner to ensure that their Boat is properly maintained, equipped, and safe.
- Availability: Rent Boat Cyprus does not warrant that the Site or Service will be available on an uninterrupted, timely, or secure basis.
- Accuracy of Information: Rent Boat Cyprus does not warrant the accuracy, completeness, or reliability of any information provided on the Site or through the Service, including but not limited to Boat descriptions, pricing, availability, and user reviews.
Limitation of Liability:
- Exclusion of Damages: To the maximum extent permitted by applicable law, Rent Boat Cyprus will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or Service, or any Rental transaction, including but not limited to damages for:

- Personal injury or property damage
- Liability Cap: Except to the extent any additional contract expressly states otherwise, Rent Boat Cyprus’s maximum aggregate liability to you for all damages arising out of or related to the Site, the Service, or any Rental transaction, regardless of the form of legal action, will be limited to the total amount of the Rent Boat Cyprus commission paid by you for the specific Rental that is the subject of the claim.
- No Liability for User Disputes: Rent Boat Cyprus will not be liable for any disputes, disagreements, or claims arising between Users (Owners and Renters) related to the Rental contract, the Boat, the rental period, payment, security deposits, damages, or any other aspect of the Rental transaction.
No Professional Advice: Nothing on the Site or through the Service constitutes or is meant to constitute legal, financial, or medical advice. If you require such advice, you should consult with an appropriate professional.
22. Privacy
Information Accuracy: To access the Site and/or Service, you may be required to provide certain information about yourself as part of the registration process. You agree that any information you provide will always be accurate, correct, and up-to-date.
Data Protection: Rent Boat Cyprus takes your personal data seriously and is committed to protecting your privacy. Rent Boat Cyprus will not use your email address for unsolicited mail. 25 Assignment
You may not assign, transfer or sub-contract any of your rights and/or obligations under these Terms and conditions, in whole or in part, to any third party without our prior written consent. Any purported assignment in violation of this Section will be null and void.
26. Breaches of these Terms and conditions
Remedies for Breach: Without prejudice to any other rights or remedies available to Rent Boat Cyprus under these Terms and Conditions or applicable law, if you breach these Terms and Conditions in any way, Rent Boat Cyprus may take such action as it deems appropriate to deal with the breach. This may include, but is not limited to:
- Suspension of Access: Temporarily or permanently suspending your access to the Site and/or Service.
- Account Termination: Terminating your account.
- Content Removal: Removing any content you have posted on the Site.
- Contacting ISP: Contacting your internet service provider to request that they block your access to the Site.
- Legal Action: Commencing legal action against you.

- Any Rental transaction between you and another User.
You will promptly reimburse Rent Boat Cyprus for any damages, losses, costs, and expenses (including reasonable attorneys’ fees) relating to or arising out of such claims.
28. Waiver
No failure or delay by Rent Boat Cyprus in exercising any right, power, or privilege under these Terms and Conditions will operate as a waiver thereof, nor will any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.
29. Language
These Terms and Conditions will be interpreted and construed exclusively in English. All notices and correspondence will be written exclusively in that language.
30. Entire agreement
These Terms and Conditions, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Rent Boat Cyprus relating to your use of the Site and Service and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
31. Updating of these Terms and conditions
Right to Update: Rent Boat Cyprus reserves the right to update or modify these Terms and Conditions at any time, at its sole discretion.
User Responsibility: It is your responsibility to periodically check these Terms and Conditions for changes or updates. The date provided at the beginning of these Terms and Conditions is the latest revision date.
Effective Date: Changes to these Terms and Conditions will become effective upon such changes being posted to the Site.
Acceptance of Changes: Your continued use of the Site or Service following the posting of changes or updates will be considered notice of your acceptance to abide by and be bound by the revised Terms and Conditions.
32. Governing Law and Jurisdictionand Jurisdiction
